Online Rental Agreement, Terms & Release of Liability

PARADISE BABY CO LLC. Version 2026-10-20. This is the agreement you accept when you book, and the one recorded against your order.

By completing this reservation, submitting payment, checking the acceptance box, or accepting delivery of rental equipment, I agree to the following terms:

Rental & Delivery

All rental items are subject to availability. Product brand, model, color, or appearance may vary from website photos, and Paradise Baby Co LLC may substitute a comparable item when necessary.

Unless otherwise arranged, deliveries are generally made between 8:00 a.m. and 2:00 p.m.

Rentals are charged for a minimum of 3 days.

I am responsible for providing accurate delivery information and notifying my hotel, vacation rental, host, property manager, or other accommodation provider that Paradise Baby Co will be delivering equipment.

Hotel deliveries may be left with the bell desk or designated hotel area.

Current bell desk/service fees are:

• Standard hotels: $10
• Aulani Resort: $20

Additional hotel, parking, access, handling, or delivery fees may apply when incurred.

Vacation rental deliveries require accurate access instructions and contact information.

Multiple delivery or pickup locations may result in additional charges.

Airport delivery may be available for an additional fee.

Return & Pickup

All rental equipment must be ready for pickup by 10:00 a.m. on the scheduled return date unless other arrangements have been confirmed.

Equipment must remain at the original delivery location unless Paradise Baby Co approves another return location in advance.

Rental extensions must be requested at least 24 hours before the scheduled return date and are subject to availability.

Equipment Responsibility

I accept responsibility for the rental equipment from the time it is delivered until it is returned to or recovered by Paradise Baby Co.

I agree to:

• use all equipment only for its intended purpose;
• follow manufacturer instructions, warnings, age restrictions, weight limits, and safety requirements;
• supervise children at all times;
• stop using any item immediately if it appears damaged, defective, unstable, incomplete, or unsafe;
• promptly notify Paradise Baby Co of any problem;
• protect equipment from theft, loss, excessive dirt, weather, water damage, smoke, animals, misuse, and avoidable damage; and
• not modify, alter, dismantle, repair, or disable safety features on any equipment.

Rental equipment is not a substitute for adult supervision.

I am responsible for determining whether rented equipment is appropriate for the age, weight, size, development, and needs of the child using it.

Car Seats & Safety Equipment

For car seats and other safety-related equipment, I am responsible for confirming that the item is appropriate for the child and compatible with the vehicle or location where it will be used.

Unless Paradise Baby Co specifically agrees otherwise in writing, I am responsible for installation and final verification of proper installation.

Any assistance or demonstration provided by Paradise Baby Co does not replace my responsibility to follow the manufacturer’s instructions.

Condition, Loss & Damage

I agree to inspect the equipment upon receipt.

Unless I promptly notify Paradise Baby Co of an issue, I acknowledge that the equipment was received in reasonably good, clean, and working condition.

I am financially responsible for loss, theft, destruction, excessive damage, missing accessories, missing parts, or misuse occurring while the equipment is in my possession or control.

I agree to pay the reasonable:

• repair cost;
• replacement-part cost; or
• replacement value

when applicable.

Normal wear from proper use will not be charged.

Cleaning

Equipment must be returned in reasonably clean condition.

An additional cleaning fee of $20 or more may be charged if equipment requires cleaning beyond Paradise Baby Co’s normal cleaning and sanitizing process.

Additional cleaning charges may apply for excessive food, stains, sand, mud, sunscreen, oils, bodily fluids, smoke, pet hair, or similar conditions.

Payment Authorization

I authorize Paradise Baby Co to charge the payment method provided for amounts properly due under this agreement, including:

• additional rental days;
• approved or unauthorized extensions;
• return-trip fees;
• additional delivery or pickup fees;
• cleaning fees;
• damaged equipment;
• lost or stolen equipment;
• missing parts or accessories; and
• reasonable repair or replacement charges.

Cancellation Policy

All cancellations are subject to a $25 service fee.

Cancellations made within 48 hours of scheduled delivery may be charged one full rental day in addition to applicable nonrefundable service or delivery fees.

Cancellations made on the scheduled delivery date may be charged 50% of the total rental and delivery amount.

If I end my rental early after it has begun, the portion already used is nonrefundable.

Any refund for the remaining unused rental period will be limited to 50% of otherwise refundable unused rental charges.

Delivery, airport, rush, bell desk, service, or other fees that have already been incurred may be nonrefundable.

Assumption of Risk & Release of Liability

I understand that the use of baby equipment, children’s equipment, recreational equipment, beach equipment, and other rental products may involve inherent and unforeseen risks.

I voluntarily assume the risks associated with possession, transportation, setup, installation, supervision, and use of the rental equipment by me, my children, family members, guests, caregivers, or others permitted to use the equipment.

To the fullest extent permitted by law, I release and agree not to sue Paradise Baby Co LLC, its owners, members, employees, contractors, representatives, and agents for claims arising from possession or use of the rental equipment, including claims involving bodily injury, property damage, disability, or death.

This release is intended to include claims arising from ordinary negligence to the fullest extent permitted by Hawaii law.

Nothing in this agreement waives any right or liability that cannot legally be waived.

Indemnification

To the fullest extent permitted by law, I agree to indemnify and hold harmless Paradise Baby Co LLC and its owners, members, employees, contractors, representatives, and agents from claims, losses, liabilities, damages, costs, and reasonable attorneys’ fees arising from:

• my misuse or improper use of rental equipment;
• failure to follow manufacturer instructions or warnings;
• failure to properly supervise a child;
• use of the equipment by someone I allow to use it;
• loss, theft, or damage while the equipment is in my possession or control; or
• my violation of this agreement.

Third-Party Use

I remain responsible for the rental equipment if it is used by my children, family members, guests, caregivers, hotel staff, vacation rental representatives, or other third parties.

Hawaii Law

This agreement is governed by the laws of the State of Hawaii.

If any portion of this agreement is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent allowed by law.

Electronic Acceptance

By checking the acceptance box, completing my reservation, submitting payment, or electronically signing, I confirm that:

• I have read and understand these terms;
• I agree to the Rental Agreement, Cancellation Policy, Assumption of Risk, and Release of Liability;
• I accept financial responsibility for the rental equipment as described above; and
• My electronic acceptance has the same legal effect as my handwritten signature.
